COMISIÓN ARBITRAL CONVENIO MULTILATERAL DEL 18.8.77

VISTO:

La Resolución General CA N° 1/2005; y,

CONSIDERANDO:

Que por la citada resolución general esta Comisión Arbitral consideró conveniente reunir en un solo texto (con sus sucesivas actualizaciones hasta 2024) las resoluciones generales dictadas por el organismo para facilitar su aplicación, sin perjuicio que el intérprete en caso de resultar necesario deba recurrir a los textos originales de las resoluciones generales para conocer los fundamentos y propósitos de su dictado.

Que en igual sentido resulta conveniente con fines prácticos, unificar en un ordenamiento jurídico integral, de edición electrónica, que integre, categorice, edite y actualice, las normas del Convenio Multilateral, su Protocolo Adicional y todas las normas públicas dictadas por los organismos de aplicación del Convenio Multilateral, exceptuando las resoluciones de casos concretos dictadas por la Comisión Arbitral y Comisión Plenaria.

Que, asimismo, el presente ordenamiento no incluye las normas que, aunque no estén expresamente derogadas, hayan caído en desuso por el transcurso del tiempo o por haberse dictado para una situación o periodo determinado pasado.

Por ello:

LA COMISIÓN ARBITRAL CONVENIO MULTILATERAL DEL 18.08.77

RESUELVE:

ARTÍCULO 1°.- Apruébase el “ORDENAMIENTO JURÍDICO DE LAS NORMAS DE LA COMISIÓN ARBITRAL”.

ARTÍCULO 2°.- El ORDENAMIENTO JURÍDICO DE LAS NORMAS DE LA COMISIÓN ARBITRAL, de edición electrónica, debe clasificarse e identificarse en las “categorías” a las que pertenecen, a saber:

ARTÍCULO 3°.- En oportunidad de publicarse cada norma en el Boletín Oficial de la República Argentina, la misma se incorporará en la edición electrónica del ORDENAMIENTO JURÍDICO DE LAS NORMAS DE LA COMISIÓN ARBITRAL, alojado en el sitio web de la COMARB: www.ca.gob.ar, encuadrándola en la categoría correspondiente de acuerdo a las establecidas en el artículo 2°.

Asimismo, cuando una norma fuere apelada, ésta se identificará como tal, y en su caso, cuando quedare confirmada por la Comisión Plenaria, se la incorporará al presente ordenamiento.

ARTÍCULO 4°.- Derógase la Resolución General N° 1/2005.

ARTÍCULO 5°.- Publíquese en el Boletín Oficial de la República Argentina, en la página web del organismo y comuníquese a las jurisdicciones adheridas.
